Under the emergency rule, employers in New Mexico will have to report coronavirus cases to the state

SANTA FE – An emergency rule filed Wednesday through the New Mexico Department of the Environment requires employers to report positive COVID-19 cases to the state among their staff.

The rule takes effect and remains in effect for 120 days.

In order for the state to respond temporarily in workplaces where positive cases are identified, the state requests employers to report positive cases to NMED’s Office of Occupational Safety and Health within 4 hours of notification that an employee has tested positive for SARS-CoV. -2 coronavirus.

When case is reported, NMED and the State Department of Health work with employers on procedures to engage the new coronavirus and institute “safe COVID” practices at their sites.

However, in its statement, the branch stated that in more than 280 cases, employers were cased at least 3 days before NMED.

Violations may be the subject of unspecified application moves through the agency.
