“He values it because, in his view, a new crisis had arisen at the border and the federal government had done very little to address it,” Gorsuch wrote.
Gorsuch noted that, in district court, an asylum seekers’ organization filed a lawsuit arguing that the government did not have the legal authority to factor Title 42 in the first place. This court sided with the asylum seekers.
Gorsuch added that in the past he noted about five months ago that “the existing border crisis is not a COVID crisis. “
“Since March 2020, we have experienced the largest intrusions into civil liberties in this country’s peacetime history. “
Gorsuch, in particular, criticized local and state governments for issuing “emergency decrees on a mind-boggling scale” and for enforcing lockdown orders that forced others to stay home.
“They closed businesses and schools, both public and private. They closed churches even as they allowed casinos and other favored businesses to continue. They threatened violators only with civil consequences, but also with criminal consequences,” Gorsuch said.
“They monitored church parking lots, registered license plates and issued notices and warned that even outdoor assembly attendance, all state necessities for social distancing and hygiene, can constitute criminal conduct. “
Gorsuch said he hopes “many lessons” can be learned from the pandemic and that “serious efforts will be made in this regard. “
