The 28-page ruling ordered local election committees to avoid counting mail-in ballots they’ve already won and “withhold” them until after Election Day on Nov. 8 or after a lawsuit filed through Republicans in the state is resolved. The resolution invalidates ballots that have already been mailed.
In 2020, delays, litigation and errors by election commissions dealing with a flood of mail-in ballots led to long waits for election results. The Democratic-controlled legislature passed a law allowing early counting of mail-in votes.

Republicans in the state celebrated as a victory for election integrity.
“Let’s hope now that they maintain our ability to make sure that our elections are conducted with integrity and that the electorate is audited and that this vote-by-mail formula, as the electorate said last November, did not need an unjustified vote-by-mail, necessarily by mail. “vote, to be conducted at the highest level, in this way to make sure that each and every citizen gets a vote,” said New York State Rep. Robert Smullen and the plaintiff in the lawsuit, according to WRGB.

Democratic leaders in the state have appealed and are pushing for a pardon.
A nonpartisan election reform organization called Common Cause New York said the ruling “could even go into effect for this election,” the New York Post reported.
