The Supreme Court made clear on Friday that the decision to introduce an odd-numbered vehicle rationing formula in the nation’s capital will have to be taken by the city government and the fee passed on to the courts.
After the day’s deliberations before the Supreme Court, which hears a case about deteriorating air quality in the Delhi National Capital Region, Environment Minister Gopal Rai said Delhi had postponed the implementation of the odd-and-even car rationing formula as there had been a noticeable improvement in air quality due to rain.
Speaking at a press conference here, Rai said the government will examine the air quality situation after Diwali and that an even odd formula could be called for in case of a sharp rise in pollutant levels.
The Delhi government had previously announced that it would put the odd-even plan into effect one day after Diwali, Nov. 13-20, when air pollutants are most likely to peak.
At the hearing before the Supreme Court on Friday, a court headed by Justice Sanjay Kishan Kaul said the court had nothing to do with the even-odd formula and never said it also applied to taxis entering Delhi from neighbouring states.
At the hearing in the case on Nov. 7, the Supreme Court questioned the effectiveness of the project, after which the city’s environment minister said it would be implemented after the Supreme Court heard the case on Friday and issued an order.
The court hears a 1985 plea by environmentalist M. C. Mehta on air pollutants. A number of problems related to pollutants were raised at the hearing of the case.
On Friday, the Supreme Court said it had pointed to the odd-even factor at the last hearing after a lawyer, assisting him as amicus curiae, said the even-odd plan does not help reduce air pollution.
The lawyer representing the Delhi government said taxis from neighbouring states deserve to be able to enter Delhi because otherwise they would become a major problem. Thousands of people who drive around Delhi live in cities such as Noida and Gurugram in Uttar Pradesh and Haryana.
“I agree with you. We never said that. Don’t try to carry it out and put the responsibility on the court. That’s what’s happening,” Judge Kaul observed.
“All of what we’ve pointed out is a factor where the amicus said that this odd-even formula doesn’t help. It didn’t turn out to be helpful. But now you’re saying we’re going to put the odd-even formula into effect. even formula and also the even-odd formula in taxis. “Are we asking you to apply the odd-even precept in taxis? We are not asking you to apply it,” the court said.
The lawyer argued that the even-odd plan does not have a very large mitigation effect on pollution, but even if it had a small impact, it would be significant.
The lawyer stated that one of the main causes of pollution, as observed in the studies, is traffic congestion on the roads and that the even-odd formula is helping to decongest them.
“What you have to do, you have to do. We are here to tell you what to do,” the court told the lawyer.
“They have to file an appeal tomorrow, they will say we told them to keep going, keep going and therefore the pollutants are because the Supreme Court has issued an order,” he said.
The Delhi government’s lawyer said the state was in firefighting mode and the scenario was bad.
“On the lighter side, what other people want to do is just pray,” Judge Kaul said, adding that the wind and rain come and that helps. He was referring to intermittent rains in Delhi and its satellite cities that have reduced air pollution levels. today.
The court said it had raised the factor of the arrival of taxis in Delhi as it affected the entire region.
“The next thing you read is they say we’re going to make ties as well,” the court said.
“I don’t know what the state government’s opinion is and then they say we’ll wait for the Supreme Court’s order. What does the Supreme Court’s order have to do with this?” said Judge Kaul.
The Delhi government’s lawyer told the court that a large number of old diesel cars had been banned due to emerging air pollution. The lawyer said studies have shown that the PM (particle) point 2. 5 was reduced by an average of thirteen percent when the odd-numbered uniform formula was in effect.
“What the amicus said, we reported. What you want to do, you do. Don’t tell us what you do. But we only point out that this is a minimal impact. If you want to do it, do whatever you want to do,” the court said.
Since the even-odd formula doesn’t apply to two-wheelers, other people with cars want a two-wheeler as well.
Introduced in 2016, the even-numbered car rationing formula allows cars to circulate each day based on their license plates or pairs. If implemented, it would be the fourth time the Delhi government has implemented the plan to combat vehicular pollution.
According to a 2018 study by the Energy and Resources Institute, vehicle emissions contribute around 40% to PM 2. 5 pollutants in the capital.
