Germany’s most sensible legislative body, the Bundestag, gave its final approval on Friday to a law that makes it less difficult to replace gender and first convocation with an undeniable public statement.
For those who oppose the existing system, a judicial decision is not easy, it is intrusive, costly and humiliating.
Under existing transgender law, other people can only officially replace their first denomination and gender after they have been evaluated by two psychiatrists and the court has given permission.
The law of self-determination would allow those adjustments to be made according to an undeniable procedure. The law defines a trans user as one who does identify with the gender that was assigned to them at birth, or only with that gender.
The law also applies to those who do not identify exclusively as male or female, known as non-binary people.
The law would require other people to notify registration offices three months before the changes are made.
In the case of persons under 14 years of age, only the person’s legal representative will proceed. Those over 14 years of age can register it themselves with the agreement of their legal representatives. If approval is not given, it will be appealed to a family court. It will likely approve the adjustments if the official adjustments in terms of sex and ask “do not go against the welfare of the child. “
The bill allows operators of services such as gyms and women’s locker rooms to continue with who has access to them.
With this new law, Germany is following the example of Spain, which in early 2023 adopted a law that allowed other people over the age of 16 to replace their legally registered sex without any medical checks.
