The Fifth Circuit appeals panel heard arguments in October. His written resolution said Biden’s executive order was illegal because Congress had not given him transparent authority in federal procurement legislation to mandate COVID-19 vaccines.

The resolution was drafted by Circuit Judge Kurt Engelhardt and approved by Judge Don Willett, appointed to the court through President Donald Trump. Justice James Graves, nominated by President Barack Obama, a dissident.
